These Terms and Conditions ("Terms") govern the use of kayaking services provided by Joe
Bananas Kayak Tours ("the Company"). By booking a kayaking tour or renting kayaking
equipment from the Company, you agree to comply with these Terms. Please read these
Terms carefully before using our services.
1. Booking and Payment:
1.1. To book a kayaking tour or rent kayaking equipment, customers must make a
reservation through any of our various platforms.
1.2. Full payment is required at the time of booking to secure your reservation.
1.3. We accept different payment methods managed by a secure payment gateway
(PayGenuis).
2. Cancellation and Refund Policy:
2.1. Cancellations made by customers must be communicated to the Company at least
24 hours before the scheduled tour or rental period.
2.2. Cancellations made within 24 hours of the scheduled tour or rental period are nonrefundable.
2.3. The Company reserves the right to cancel or reschedule tours due to inclement
weather or other unforeseen circumstances. In such cases, customers will be offered a full
refund or the option to reschedule.
3. Safety:
3.1. Customers are required to wear a personal flotation device (PFD) at all times while
kayaking.
3.2. Customers must follow the instructions provided by the Company's guides and staff
for their safety.
3.3. Customers must inform the Company of any medical conditions or physical
limitations that may affect their ability to participate in kayaking activities.
4. Equipment:
4.1. The Company provides well-maintained kayaks and safety equipment for all
customers.
4.2. Customers are responsible for any damage caused to the equipment due to
negligence or misuse.
5. Liability:
5.1. The Company is not liable for any injuries, accidents, or losses incurred during the
use of our kayaking services, except in cases of proven negligence on the part of the
Company.
5.2. Customers are responsible for their personal belongings during kayaking activities.
6. Code of Conduct:
6.1. Customers must respect the natural environment and wildlife while kayaking.
6.2. Customers must not engage in any behaviour that may endanger themselves or
others.
7. Alcohol and Drug Policy:
Management reserves the right to refuse admission to unruly passengers who appear to be
under the influence of alcohol or any banned substances.
No alcohol may be carried on-board our vessels and strictly no smoking is allowed.
8. Indemnity:
All customers are required to sign an indemnity form for all activities they are participating
in before departure of any activities.
If customers do not sign the indemnity form, the guest will not be able to partake in the
activity.
The indemnity form must be signed by a Parent/Legal guardian for minors under 18 years.
Any unaccompanied child 18 or under requires the indemnity to be signed by a parent/legal
guardian prior to the activity.
9. Child Policy:
Minimum age is 10. They also have to be accompanied by an adult.
By using the kayaking services provided by the Company, you agree to comply with these
Terms and Conditions. The Company reserves the right to amend these Terms at any time
without prior notice. It is the customer's responsibility to review these Terms regularly for
any updates or changes.
These Terms and Conditions are governed by the South African Law
